These Terms and Conditions govern your access to and use of The Love Charm Collective website and your purchase of our botanical skincare, self-care products, books, bundles and other products.

The website and online store are operated by Tracey Rovere, trading as The Love Charm Collective, ABN 47 566 573 825.

Throughout these Terms and Conditions, “The Love Charm Collective”, “we”, “us” and “our” refer to the business operating this website. “You” and “your” refer to a website visitor, customer or purchaser.

By accessing our website, creating an account, submitting information or placing an order, you agree to these Terms and Conditions and our Privacy Policy.

Please read these terms carefully before using our website or purchasing a product.

6. Orders

An order is an offer by you to purchase the products listed in your shopping cart under these Terms and Conditions.

After placing an order, you may receive an automated email acknowledging that your order has been received. This acknowledgement does not necessarily mean that the order has been accepted or dispatched.

We may accept or decline an order for legitimate reasons, including:

  • A product being unavailable

  • Incorrect product or pricing information

  • Suspected fraud or unauthorised payment

  • An incomplete or invalid delivery address

  • Payment not being authorised

  • Quantity restrictions

  • An inability to deliver to the supplied address

  • A suspected resale or commercial purchasing arrangement not approved by us

If we cancel an order after payment has been received, we will provide a refund to the original payment method unless another method is agreed with you.

7. Product Availability

All products are subject to availability.

Placing a product in your shopping cart does not reserve that product. A product may become unavailable before checkout is completed.

If an item becomes unavailable after you place an order, we may:

  • Contact you to offer a suitable alternative

  • Place the product on backorder with your agreement

  • Remove the unavailable item and refund its price

  • Cancel and refund the affected order

We will not substitute a product without your agreement.

8. Prices and GST

Unless otherwise stated:

  • Prices are displayed in Australian dollars

  • Prices include GST where GST applies

  • Delivery charges are calculated separately unless free shipping applies

  • The total payable amount will be displayed before you submit your order

Prices, discounts and promotions may be changed at any time before an order is accepted.

A price change will not affect an order that has already been accepted, except where there has been an obvious pricing or technical error and the order has not yet been dispatched.

9. Pricing Errors

We take reasonable care when displaying prices and product information. However, errors may occasionally occur.

If a product is listed at an obviously incorrect price due to a typographical, technical or system error, we may contact you before dispatch and offer you the choice to:

  • Proceed at the correct price, or

  • Cancel the affected item or order for a full refund

We will not charge an additional amount without your authorisation.

10. Payments

Orders must be paid for using one of the payment methods displayed during checkout.

By submitting payment details, you confirm that:

  • You are authorised to use the payment method

  • The information provided is accurate

  • Sufficient funds or credit are available

  • The payment is not connected to fraudulent or unlawful activity

Payments may be processed by independent third-party payment providers. Those providers may apply their own terms, security procedures and privacy policies.

We do not intentionally store complete debit or credit card numbers or card security codes on our own website systems.

Your order may be delayed or cancelled if payment is declined, reversed, disputed or identified as potentially unauthorised.

11. Promotions and Discount Codes

Promotional offers, bundles, sale prices and discount codes are subject to the conditions displayed with the relevant offer.

Unless otherwise stated:

  • Only one discount code may be used per order

  • Discount codes cannot be exchanged for cash

  • Discounts cannot be applied after an order has been placed

  • Promotions may have a stated expiry date

  • Promotions may be limited to selected products or customers

  • Minimum-spend requirements may apply

  • Delivery charges may not count towards a minimum spend

  • Promotional offers are subject to product availability

We may withdraw or correct a promotion where it contains a genuine error, has been misused or is affected by unauthorised activity.

Nothing in this section limits your rights under the Australian Consumer Law.

12. Free Shipping Offers

We may offer free standard shipping within Australia when an order meets the minimum purchase amount displayed on our website.

Unless otherwise stated:

  • The qualifying amount is calculated after discounts

  • Delivery fees and other charges do not count towards the qualifying amount

  • The order must be delivered to an eligible Australian address

  • Oversized, remote-area or special-delivery charges may be excluded

  • The offer cannot be exchanged for cash

The current free-shipping threshold and applicable conditions will be displayed on the website and may be updated for future orders.

13. Australian Delivery

We deliver to eligible addresses throughout Australia.

Customers are responsible for providing a complete and accurate:

  • Recipient name

  • Street or postal address

  • Suburb

  • State or territory

  • Postcode

  • Email address

  • Telephone number, where required

Orders are generally prepared within a few business days. Estimated processing and delivery times are guides only and are not guaranteed delivery dates.

Delivery may be affected by:

  • Public holidays

  • Courier or postal delays

  • Severe weather

  • Natural disasters

  • Remote delivery locations

  • High order volumes

  • Incorrect address details

  • Events outside our reasonable control

Once an order has been dispatched, tracking details may be sent to the email address provided at checkout.

14. International Orders

International shipping may only be available to selected destinations and may require approval before an order is placed.

International customers are responsible for checking whether our products can legally be imported into their country.

Unless otherwise agreed, the customer is responsible for:

  • International delivery charges

  • Customs duties

  • Import taxes

  • Brokerage fees

  • Local handling charges

  • Import permits or restrictions

We are not responsible for customs delays or goods refused by an overseas authority where the refusal results from the customer failing to check local import requirements.

Where an international order cannot be fulfilled, we will contact the customer and refund the affected payment.

15. Delivery Address Errors

Please review your delivery information carefully before submitting an order.

Contact us as soon as possible if an address needs to be corrected. We cannot guarantee that an address can be changed after an order has been processed or dispatched.

If an order is returned because the address supplied was incorrect, incomplete or inaccessible, we may require payment of reasonable additional delivery costs before sending it again.

This does not apply where the delivery problem was caused by us or our delivery provider.

16. Authority to Leave and Delivery Risk

Where a customer requests or permits an order to be left unattended, the customer accepts the risk of loss, theft, weather damage or interference after the parcel has been delivered according to those instructions.

Where no authority to leave has been provided, the delivery provider may:

  • Leave a collection notice

  • Redirect the parcel to a collection location

  • Attempt redelivery

  • Return the parcel to us

Any collection or redelivery requirements may be subject to the delivery provider’s procedures.

Nothing in this section limits rights available under Australian Consumer Law where goods were not delivered as agreed.

17. Delayed or Missing Deliveries

If your order has not arrived within the expected delivery period, contact us with your order number and tracking information.

We will make reasonable enquiries with the delivery provider.

A parcel will not necessarily be considered lost solely because it is delayed. Where an order is confirmed as lost before delivery, we will provide an appropriate remedy, which may include replacement or refund.

18. Damaged, Incorrect or Incomplete Orders

Please inspect your order after delivery.

Contact us promptly if:

  • A product arrives damaged

  • You receive the wrong product

  • An item is missing

  • A parcel appears to have been damaged in transit

Please provide:

  • Your name

  • Order number

  • A description of the issue

  • Clear photographs of the product, packaging and shipping label where reasonably available

Photographs help us assess the issue and make a claim with the delivery provider. However, failure to provide photographs does not automatically remove rights available under the Australian Consumer Law.

19. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Consumer guarantees may apply where a product:

  • Is faulty, defective or unsafe

  • Is not of acceptable quality

  • Does not match its description

  • Does not correspond with a sample or demonstration

  • Is not fit for a disclosed purpose

  • Does not have the qualities or performance represented

Your rights under the Australian Consumer Law apply in addition to any voluntary return or exchange policy we may offer.

Nothing in these Terms and Conditions excludes, restricts or modifies a right, guarantee, condition, warranty or remedy that cannot legally be excluded.

20. Remedies for Faulty Products

The remedy available for a faulty product depends on whether the failure is major or minor and on the requirements of Australian Consumer Law.

For a major failure, you may be entitled to:

  • Reject the product and choose a refund or replacement

  • Keep the product and seek compensation for its reduction in value

  • Claim compensation for other reasonably foreseeable loss or damage where legally available

For a minor failure, we may be entitled to provide an appropriate remedy within a reasonable period.

Refunds for products that fail to meet a consumer guarantee will generally be made using the original payment method unless another method is agreed.

We will not charge a restocking, processing or administration fee for a remedy required under Australian Consumer Law.

21. Change-of-Mind Returns

You are not automatically entitled to a refund or exchange because you:

  • Changed your mind

  • Ordered the wrong product

  • Found a product elsewhere at a lower price

  • No longer require the product

  • Dislike a fragrance or texture where the product is otherwise as described

  • Experienced a result different from your personal preference where the product is not faulty

For hygiene, safety and contamination reasons, opened or used skincare and personal-care products generally cannot be accepted for a change-of-mind return.

At our discretion, we may consider a change-of-mind return where the product is:

  • Unopened

  • Unused

  • Undamaged

  • In its original sealed packaging

  • Suitable for resale

  • Accompanied by satisfactory proof of purchase

You must contact us before returning an item. Unauthorised returns may not be accepted.

Where a discretionary change-of-mind return is approved:

  • The customer is responsible for return delivery costs

  • Original delivery charges are generally not refundable

  • The customer is responsible for the parcel until it reaches us

  • A refund will be processed after the returned product has been inspected

This change-of-mind policy does not limit remedies available for faulty, damaged, unsafe or incorrectly supplied goods.

22. Allergies, Sensitivities and Personal Reactions

Customers are responsible for reviewing product ingredients before purchase and use.

A personal allergy, sensitivity or reaction does not necessarily mean that a product is defective. However, we take product safety concerns seriously.

If you experience an adverse reaction:

  • Stop using the product

  • Follow appropriate medical advice where required

  • Retain the product and packaging

  • Contact us with the product name, batch information and relevant details

We may request reasonable information to assess the issue, investigate the relevant batch or meet a product-safety obligation.

Nothing in this section limits your rights where a product is unsafe, defective, incorrectly labelled or otherwise fails to meet a consumer guarantee.

23. Returns Process

If the return is approved, we will provide instructions for returning or otherwise dealing with the product.

Unless we confirm otherwise, products should not be sent to our location without prior return instructions.

Please retain proof of postage or tracking information for any return parcel.

24. Refund Processing

Approved refunds will be processed within a reasonable period after:

  • We approve the refund

  • The returned product is received where a return is reasonably required

  • The issue has been assessed

  • Any required payment-provider process has been completed

Refunds will generally be issued to the original payment method.

The time taken for funds to appear after processing may depend on your bank or payment provider.

25. Order Cancellations

Contact us immediately if you wish to cancel an order.

We may be able to cancel an order if it has not entered processing or been dispatched. Cancellation cannot be guaranteed once fulfilment has started.

If an order has already been dispatched, it may need to be handled under our returns provisions.

We may cancel an order where:

  • Product or pricing information contains a genuine error

  • We reasonably suspect fraud or unlawful activity
